The abuse of those who are in a disadvantaged situation degrades the human condition of those who exercise it and a legal system in which the weakest are ignored cannot be fair or ethical.

In our country, social networks expose more and more aberrant cases of animal abuse every day, from dogs "raped" by their owners, to atrocious mutilations, torture and deaths caused with immeasurable cruelty.

Violence against animals generates violence in and against human beings, and we are not just referring to what has been thrown up by the number of psychocriminological studies, such as those of the Human Society organization, among others, which mark as undeniable the close link between violence animal and interpersonal violence (children, women, the elderly). We are referring to the negative attitudes that they trigger in and for society.

The safeguarding of animals against unjustified cruelty stems from a social, cultural and environmental concern and need.

Many of the parliamentary efforts to channel mistreatment have been hampered or frustrated due to problems in identifying the legal right, amount of penalties, questions of formality, etc. The urgent and imperative need to have suitable instruments, capable of inhibiting unjustified cruel behavior and promoting a culture of respect and animal protection led us to carry out this initiative that: we consider to be in accordance with the law, collects the claims of the population and the current trends in comparative law. Therefore, the existing legal framework must be enriched, with a much more holistic vision of the issues it addresses and its solutions, and with a more biocentric spirit.

We must introduce the crime of bestiality into our legislation and also consider the life of animals as a legal asset that must be protected by criminal law.
