The need to regulate responsible ownership of urban animals in the city of Paso de los Libres, and

CONSIDERING:

That the intention of this project is to promote the responsible possession of the "urban animals", thus defining the domiciliary animals that live with the people, sharing their place of residence, as pets or work animals; those who are in a street situation: who live on public roads without identified forks; and the community that are the animals in street situation, but protected and fed by the community.

That incidents with animals may occur, that being loose in public roads cause accidents of varying severity.

That it is a necessity to take preventive measures in order to avoid accidents with animals on public roads.

That the owners of animals must necessarily assume the responsibilities of care, hygiene, health and safety, of them as well as of the people with whom they live in society.

That it is necessary to implement measures for those cases in which the owners or owners of animals do not assume their responsibilities.

That they should continue with the mass castrations of domestic animals as well as the actions and prevention campaign aimed at reducing the overpopulation of domestic and stray animals, in pursuit of the preservation of the ecological balance and the health of the population.

That it is essential to address this situation taking into account the risk it represents for public health.

That it is necessary to carry out actions to raise awareness among the population about abandonment and animal abuse, taking into account that they are living beings with the capacity to feel.

That it is necessary to raise awareness about the importance of the castration of dogs and cats in order to avoid the indiscriminate increase of animals that end up in a situation of neglect and abuse.

THE DELIBERATING COUNCIL

ORDINANCE

CHAPTER I: GENERAL PROVISIONS

Article 1: DEFINITIONS

Urban Animals: domiciliary animals that live with people, sharing their place of residence, as pets or work animals; those who are in a street situation: who live on public roads without identified forks; and the community that are the animals in street situation, but protected and fed by the community.

Fork of an animal: is responsible for it, refers to who cares and feed it, integrate it into your home so that it becomes your company. They will be obliged to comply with the provisions of this Ordinance, being subsidiaries responsible for people living in the houses, establishments or premises where the animals are located.

Responsible tenure: is the careful observation of the set of specific measures consisting of providing the canine and feline population with an adequate supply of food, shelter, containment, health care and good treatment throughout life, also avoiding the risk that could generate as potential aggressors or transmitters of diseases to the human community, animals or the environment.

Article 2: Adhere to National Law No. 14.346, which is a bulwark in the relationship that must be established between the human species and other species, expressing the principle of equality of species in terms of life and providing humanity with a code of biological ethics.-

Article 3: Adhere to National Law No. 27.330 "It is prohibited throughout the national territory of dog racing, whatever their race, as well as who for any reason organize, promote, facilitate or conduct a dog race, whatever your race".-

CHAPTER II: OF ANIMALS IN GENERAL

It's forbidden:

Article 4: Leave animals loose or tied in the streets, roads, public places and private property, where their possession is not allowed for reasons of health, hygiene or safety, which are not properly fenced and / or closed.

Article 5: Cause their death or extermination directly or indirectly of healthy animals, use them for hunting or fights causing unnecessary torture or mutilation or sickness with treatment or recovery capacity. Leave them in closed or rental-free homes, on public roads, cars, balconies, plots or gardens.

Article 6: Its purchase and sale in spaces that are not authorized for it. Place them out in the open without adequate protection from weather conditions and not give them adequate rest in the case of working animals. Organize, assist or promote animal fights. Encourage animals to attack each other or to people and vehicles.

Article 7: Abandon an animal or its puppies so that they are left in distress or exposed to a risk that threatens their physical integrity or that of third parties. Leaving animals on public roads after they have been victims of traffic accidents, confrontations with other animals, or who are injured for any reason, has been the person causing the injuries or not. Hitting, injuring, poisoning, torturing or physically or sexually assaulting an animal, as well as subjecting them to any practice that causes harm or suffering, not providing enough water and food, having them tied permanently, or not providing veterinary attention when they need it. Perform medical acts of veterinary medicine, without having a qualification that enables it.

Article 8: Let the animals roam loose without control being exposed to risks that threaten their physical integrity or that of third parties. It is exempt from this situation to feline animals that may circulate loose provided they are properly sterilized and sanitized, and do not represent any damage to neighbors, bystanders or other animals.

Article 9: For a better implementation of this ordinance, it will be necessary to give wide dissemination and awareness-raising tasks on the part of the Municipality, and implement measures to control the canine and feline population through mass surgical sterilization campaigns. These sterilization campaigns must be carried out based on agreements signed between the Municipal Executive Department and the different Animal Protective Associations and other protectionist entities.

CHAPTER III: OF DOGS AND CATS

Article 10: The owners or owners of dogs and / or cats are obliged to comply with the provisions of this Ordinance, with the owners of the houses, establishments or premises where the animals are located, being the subsidiary responsible.

Article 11: The holder is responsible for providing the animal with an environment in optimal hygienic conditions and with the basic requirements for its welfare; the adequate food, the resting space protected from inclement weather, the space to eliminate waste, recreation and physical exercise.

Article 12: The holder is responsible for the health and maintenance of the animal's health, being obliged to vaccination, deworming and surgical sterilization, the latter being considered important for the control of the indiscriminate reproduction of animals.

Article 13: It will be the responsibility of the holders who transit with animals on public roads to collect their excrement or waste in bags and dispose of them in suitable sanitary conditions. In case of non-compliance, they will be subject to the penalties provided, upon prior notification and verification of the lack.

Article 14: The owner of the dog must attend at all times to the vaccination schedule established by the direction of municipal bromatology for this purpose, stating this obligation in the sanitary control book that every animal must have.

Article 15: To facilitate the application of this Ordinance and have information to prevent possible cases of diseases arising from the animal population, the Municipal Executive Department may create a dog and / or pet registry, controlled by the organ or service that is created or considered appropriate for the purpose.

CHAPTER IV: ANIMAL PROTECTION

Article 16: Animals whose owners are reported for causing harm, abuse in general, and who do not meet the conditions imposed by sanitary regulations, may be confiscated in accordance with current legislation if their owners do not adopt the corrective measures that may be appropriate.

Article 17: Fines for non-compliance with the provisions of the articles that are part of this ordinance, will be imposed after the intervention of the comptroller agency with the corresponding condemnatory decision.

Article 18: Designate as authority of application of this Ordinance to ........................................... of Paso de los Libres.

Article 19º: The sanction applied by the municipal authorities does not remove the civil or criminal liability for which the owner must respond for the damage done to the animal.

Article 20: Those who violate the provisions of the articles of this ordinance, will be sanctioned with minor or serious fines, being fines fines the assistance to community tasks for 12 months once a week controlled by who is responsible for the tasks to be performed, being serious fines of $ 5,000 to $ 10,000 and / or withdrawal of license and / or disqualification, in case the application authority considers that it should apply to the offender.

Article 21: Publicity: The Municipal Executive Department through the corresponding Secretariat together with Protective Animal Associations and other protectionist entities will carry out, as of the effectiveness of this Ordinance, the Advertising Campaign, for the information of the population regarding this issue in order to raise awareness among citizens of the importance of proper care of pets and encourage responsible ownership.
